(TotalConservative.com) – Following a federal court decision to dismiss the classified documents case against former President Donald Trump, Democrats reeled over the decision and called for the removal of the judge who made the call.
On Monday, July 15, Judge Aileen Cannon tossed out the case against Trump for allegedly mishandling government documents after leaving office in 2021. The judge ruled, according to an assessment by Supreme Court Justice Thomas Clarence, that special prosecutor Jack Smith was ineligible to prosecute the case because US Attorney General Merrick Garland illegally appointed him.
Democrats immediately slammed the decision. Senate Majority Leader Chuck Schumer of New York called it “breathtakingly misguided.” Schumer said the ruling should be “appealed immediately” because it defies legal precedence. He also called it “further evidence” that the judge isn’t able to handle Trump’s case “impartially,” calling for Cannon’s reassignment.
Rep. Jamie Raskin of Maryland, a high-ranking member of the Oversight Committee, said the decision must be “reversed immediately.” Raskin claimed that Attorney Generals have been able to name special counsels for “sensitive investigations” for at least 25 years.
Laurence Tribe, a professor of law at Harvard, believes the basis of the judgment was wrong and that the Justice Department “must appeal right away.” He also believes Cannon’s decision may give Smith grounds to “seek her removal.” In another post, Tribe accused the judge of political opportunism, calling the ruling Cannon’s “job application” for a Supreme Court justice position if Trump returns to the White House.
Republicans unanimously praised the ruling, including House Speaker Mike Johnson, who called it “good news” for the country and “for the rule of law.” Johnson said that as the government works “to unify” the country after the attempted assassination of Trump, they must also work to end “political witch hunts” in the form of lawfare that have targeted the former president “unfairly” and destroy general faith in the US justice system.
Critics of the indictment consider it a waste of money after the DOJ dumped about $24 million into the case since its inception. Although Trump’s team believes Smith will certainly appeal the ruling, the case will not move to trial before the November election.
