(TotalConservative.com) – New Mexico Gov. Michelle Lujan Grisham has become the target of national scrutiny over her attempt to ban concealed and openly carried firearms in her state. Executive Order 2023-130 painted gun violence as a “public health emergency” and under that authority attempted to dissolve the Second Amendment rights of law-abiding citizens. The order prohibited possession of a firearm in certain jurisdictions with high levels of gun violence.
It was immediately attacked by members of both parties across the nation. One ammo manufacturer looking to push back is offering free shipping to residents of the state until Grisham is impeached or the order quashed in court. He pointed out that politicians will push unconstitutional executive orders (as they did during the pandemic) knowing that the courts will overturn them, but also knowing that their constituents will have to live under the illegal orders for months until that can happen.
Signaling that future is closer than one might think, a Biden-appointed federal judge just granted a temporary restraining order blocking the most substantial portions of the order, sections 1 and 4 which prohibited people from carrying firearms in certain public areas. U.S. District Court Judge David Herrera Urias heard oral arguments from five separate lawsuits, all of which used the Second Amendment as their major argument for a temporary restraining order. They cited multiple Supreme Court precedents, including one from 2022, that clearly affirmed an individual’s right to own and carry a firearm for self-defense in public. They argued that even a public health emergency does not grant the governor the ability to suspend those rights.
Additionally, New Mexico Attorney General Raul Torrez publicly told the governor that he won’t defend her in court, despite his office’s legal obligation to do so, as he has a higher obligation to the constitution. He said that her order likely fails to pass “constitutional muster,” and encouraged her to work with state legislators instead of taking questionable unilateral action.
