(TotalConservative.com) – The Senate rejected a District Court judge nominee put forward by President Joe Biden who once permitted a male rapist to be placed in a women’s prison because the man identified as transgender, putting the female prisoners at risk.
Biden backed Sarah Netburn for New York’s Southern District US District Court, but the Senate Judiciary Committee rejected the president’s nomination on Thursday, July 11, in a vote of 10-11.
Netburn stirred up criticism among conservatives and Republican lawmakers in 2022 when she recommended that a male prisoner with a record of serial rape be transferred to a female prison in line with the inmate’s so-called “gender identity.” The inmate, born William McClain and now going by the name “July Justine Shelby,” has an extensive record of sexual misconduct and Netburn was aware of this record before recommending the transfer.
One Democrat, Sen. Jon Ossoff of Georgia, diverged from his conference to side with his Republican colleagues in voting against Netburn.
During a committee hearing on May 22, Republican Sen. Ted Cruz blasted Netburn for allowing a “six-foot-two serial rapist, serial child rapist, with male genitalia” to be housed in a women’s prison.
In 1994, the trans-identifying inmate was convicted of raping a teenage girl and molesting a young boy. In 2015, he was released and then later arrested and charged again in 2017, this time for possession and distribution of child pornography. After the transfer in 2022, McClain went on to sexually harass females in the prison by exposing himself.
Netburn defended her request to transfer McClain by claiming every incarcerated person had the right “to feel safe” in the space they inhabit, implying the safety of McClain overrode that of the women he was exposing himself to.
Cruz accused Netburn of putting her political ideology before the rights of the women endangered by her decision. He called her a “radical” and said he believed she should not be a judge.
