The High People’s Court in Ho Chi Minh City found Truong My Lan guilty of embezzling $12.5 billion from the Saigon Commercial Bank (SCB). Lan’s trial stands as Vietnam’s most significant fraud case, hitting the nation’s financial market and economy hard. The illegal activity included creating fake loans to strategically embezzle funds over an 11-year period. The prosecution described the scale as unprecedented, stating, “The consequences Lan caused are unprecedented in the history of litigation.”

Lan also holds a life sentence in a separate trial concerning fraud and money laundering charges. Having controlled 91.5% of SCB shares and orchestrated fake loan applications, Lan’s fraudulent activities left thousands of investors at risk.

The Potential Sentence Reduction

Truong My Lan could have her death sentence commuted to life imprisonment if she manages to return three-quarters of the embezzled amount, approximately $9 billion. Lan has begun selling assets and securing loans. Despite having holdings exceeding the necessary compensation, liquidating real estate assets is time-consuming. Nguyen Khac Giang notes, “Moreover, if she repays at least three-quarters of the misappropriated funds, the court may consider commuting her sentence.”

Lan’s family members and business associates are also facing prison sentences. The ripple effect of the scandal led Vietnam’s central bank to inject $24 billion in “special loans” to SCB to prevent further economic fallout.

Impact on Vietnam and Involved Parties

Following Lan’s 2022 arrest, Saigon Joint Stock Commercial Bank experienced a significant financial crisis. The case impacted Vietnam to such an extent that damages amounted to $27 billion, around 6% of the country’s GDP. Lan’s legal troubles are tied to 85 defendants, including top former SCB executives and figures in Vietnam’s central banking sector.

The prosecution asserted the embezzled funds amounted to 93% of SCB’s total credit, compromising financial stability and trust within Vietnam’s economic infrastructure. Lan, intertwined with Vietnam’s anti-graft campaign “Blazing Furnace,” attempts to save herself by gathering the required compensation.
