(TotalConservative.com) – The Supreme Court is being asked by the Biden/Harris administration to overturn an injunction issued by lower courts which prohibited changes to Title IX policies regarding gender ideology from going into effect. The Department of Justice and U.S. Solicitor General Elizabeth Prelogar requested an emergency application to get the court’s opinion as soon as possible. The high court has asked for a response from Republicans suing to block the changes.
At the center of the controversy are changes to Title IX policies, which govern schools, universities, and other organizations that educate students and receive federal funding. The Biden/Harris administration has attempted to change the rules such that so-called “transgender” individuals, that is people who pretend they are the opposite gender and get very offended if you point out the pretense, can access sports, clubs, or locker rooms of the opposite sex.
The changes would also allow an expansion of the definition of “harassment” to cover instances where objectively appropriate pronouns are used to refer to people who prefer other pronouns. This would effectively compel students, faculty, and other employees of schools covered by Title IX to indulge radical gender ideology or face threat of losing crucial funding.
The core of the challenge by Prelogar and the DOJ is a June 17 ruling by a court in Kentucky which prevented the rules from being implemented while legal challenges are ongoing. The DOJ wants to limit the scope of the preliminary injunction to only apply to states that are actively challenging the changes in court and only to portions which are being directly challenged.
The Sixth U.S. Circuit Court of Appeals upheld the injunction blocking the rule changes in 15 states and to schools attended by children of the families in the Young America’s Foundation and Moms for Liberty. The updated regulations will go into effect in the remainder of the states on August 15, however.
Biden issued an executive order back in March 2021 which instructed the Department of Education to update Title IX to include discrimination based on “gender identity” and “sexual orientation.”
When the SCOTUS weighs in, they will determine how and if these rule changes can go into effect.
