DHS Causes Over 200,000k Court Cases to Be DISMISSED

(TotalConservative.com) – Immigration judges have dismissed roughly 200,000 immigration cases during the Biden administration due to failure of the Department of Homeland Security (DHS) to file the appropriate paperwork. The Notice to Appear (NTA) is a vital part of the immigration review process, it establishes a case for the illegal alien, without which they can’t have their asylum claims heard or arbitrated.

The number of dismissals is highly irregular and supports allegations the Biden administration is intentionally hamstringing immigration law to import millions of illegals. It’s been suggested that the import of illegal criminal aliens benefits Democrats in a number of ways.

They’re largely dependent on handouts and social welfare programs which the Democrats promote, and even more importantly they can add congressional districts to left-leaning states where they ultimately settle, shifting the number of representatives away from conservative states with more restrictions on illegals.

The NTA is a vital part of the process in resolving an individual’s case. It allows the government to explain to the court why the individual should be deported. The current backlog of cases is roughly 3.5 million, and DHS has already wasted opportunities to resolve and process them.

Without a case, asylum seekers here illegally aren’t able to have their requests processed. The lack of a NTA and thus an official case number prevents them from getting work permits, complicating their lives and making it more likely illegals turn to crime to provide for themselves or their families.

Cases that are dismissed must be refiled with a new NTA, and some clever tracking from TRAC for the ten years between 2014 and 2024 showed there were approximately 200,000 cases that were dismissed but had not had new NTAs filed, resulting in the individuals in question being in the U.S. illegally, indefinitely, without any potential for resolution.

TRAC also showed that DHS refiling NTAs also resulted in cases getting dismissed because the refiled NTAs were again, not done properly. The situation marks yet another strange violation of normal immigration law that has been unique to the Biden administration.
